Buchanan County Jail and Booking Process

The Buchanan County Jail is the primary detention facility for the county. When someone is arrested in Buchanan County, they are brought to the jail for booking. This process includes photographing and fingerprinting the person, recording all personal information, documenting the charges, and entering the data into the Virginia Criminal Information Network (VCIN). This network is accessible to all law enforcement agencies across the state.

After the booking process is complete, the arrested person appears before a Virginia magistrate. Virginia's magistrate system runs 24 hours a day, seven days a week. The magistrate reviews the charges and sets bail conditions. Under Virginia Code § 19.2-72, a magistrate issues arrest warrants based on sworn complaints that establish probable cause. Under § 19.2-82, a person arrested without a warrant must be brought to a magistrate promptly.

Visitation at the Buchanan County Jail requires advance scheduling and strict adherence to security protocols. Bond and bail procedures follow Virginia state guidelines. Inmate information can be accessed through the Sheriff's Office during business hours. Walk-in inquiries are permitted. For questions about a specific inmate's status or location, calling the jail directly is the fastest method.

For inmates who have been convicted and transferred to state custody, use the Virginia Department of Corrections Inmate Locator. The VADOC locator is updated daily and shows current location and release date information. You need either the inmate's full last name and first initial, or their seven-digit VADOC inmate ID number.

FOIA Rights for Buchanan County Booking Records

Law enforcement agencies including the Buchanan County Sheriff's Office must release the identity of adults who are arrested and charged, the general description of the alleged crime, the date and location, and the name of the investigating officer. Adult booking photos are public records. Any chronological arrest log is also a public document.

To request Buchanan County arrest records, submit a written request to the Sheriff's Office. The office must respond within five working days. Arrest records in Buchanan County include the date of arrest, the charges filed, information about the arresting officer, and details of the booking process. These records can be requested formally or accessed through the online court systems for cases that have moved to the court stage. The Virginia FOIA Advisory Council at the state level provides guidance on records access rights if you have a dispute with an agency over a request.

Note: Records related to ongoing investigations, juvenile arrests, and confidential informant identities are exempt from mandatory FOIA disclosure.

How Arrests Work in Buchanan County

Most arrests in Buchanan County begin with a warrant. A law enforcement officer or a citizen can appear before a Virginia magistrate and swear to a complaint. If the magistrate finds probable cause, a warrant is issued. The warrant names the accused, describes the offense with reasonable certainty, and commands that the accused be arrested and brought before the court. Warrants are entered into VCIN and can be served by any law enforcement officer in the state.

On-scene arrests without a warrant happen when a deputy witnesses criminal activity or has probable cause based on facts at the scene. For Class 3 or 4 misdemeanors, Virginia Code § 19.2-74 allows officers to release the person on a summons rather than taking them to jail, unless the case involves DUI, public drunkenness, or the officer believes the person will not appear for court. For more serious charges, physical arrest and booking are required.

The booking record shows what happened at each step. It contains the person's name, date of birth, address, physical description, the specific Virginia statute charged, the arresting agency, the booking date and time, and the bail conditions set by the magistrate. This record is what appears in the 24 hour booking logs that the public can access through the Sheriff's Office or the online court systems.

Sealing Buchanan County Booking Records

Virginia's new record sealing law, effective July 1, 2026, creates new options for people with old arrest and conviction records in Buchanan County. About 90% of all misdemeanors and nearly two-thirds of Class 5 and 6 felonies may be eligible for sealing. Sealing removes a record from public access but does not destroy it. It will no longer appear in court database searches or standard background checks.

Automatic sealing without any filing required will cover offenses like misdemeanor larceny, trespass, disorderly conduct, and marijuana possession. For automatic sealing, the person must have no new criminal convictions for seven years after the qualifying offense. All marijuana possession records, including non-convictions and deferred dismissals, will be automatically sealed. For records that do not qualify automatically, petition-based sealing is an option. After July 1, 2026, no fingerprint card or filing fee is required for these petitions.
